The short version

  • This website explains SumContext and lets you request a meeting.
  • A visit, message, or meeting does not create a client relationship.
  • Any paid work, deliverables, fees, confidentiality, and data handling belong in a signed client agreement.

1. Acceptance and scope

These Terms of Use (“Terms”) govern access to and use of sumcontext.ai and its public pages (the “Site”), operated by Mike Sax under the SumContext name from Colorado (“SumContext,” “we,” “us,” or “our”). You must be at least 18 years old to use the Site. By accessing or using the Site, you agree to these Terms. If you use the Site for an organization, you represent that you have authority to act for that organization.

If you do not agree, do not use the Site. These Terms apply only to the public Site, not to paid services governed by a separate signed agreement.

2. The Site does not create a client relationship

The Site provides general information about SumContext and a way to request a meeting. Visiting the Site, booking a meeting, or communicating through a linked service does not create a client, advisory, fiduciary, employment, partnership, joint-venture, or other professional relationship.

Paid services begin only when SumContext and the client sign a separate written agreement, such as a master services agreement or statement of work. If that agreement conflicts with these Terms, the signed agreement controls for that engagement.

3. Informational content and AI limitations

Site content is provided for general informational purposes. It is not legal, financial, tax, accounting, cybersecurity, privacy, regulatory, medical, or other professional advice.

Descriptions, demonstrations, or examples involving artificial intelligence are illustrative. AI systems and outputs can be incomplete, inaccurate, biased, unavailable, or unsuitable for a particular use. You are responsible for obtaining appropriate professional advice and independently reviewing any decision, output, or system before relying on or deploying it.

4. Confidential and sensitive information

Do not submit confidential, proprietary, regulated, or sensitive information through the Site, a scheduling form, or an unsolicited communication. This includes passwords, access credentials, health information, financial-account information, government identifiers, trade secrets, and personal data you are not authorized to disclose.

Sending information before a written confidentiality or services agreement is in place does not create a contractual duty of confidentiality. This does not limit obligations imposed by applicable privacy law or a later signed agreement.

5. Acceptable use

You may use the Site only for lawful purposes. You may not:

  • interfere with the Site’s operation or security;
  • attempt unauthorized access to any system, account, or data;
  • transmit malicious code or use the Site to harm another person;
  • impersonate another person or misrepresent your affiliation;
  • infringe intellectual-property, privacy, publicity, or other rights; or
  • use automated means in a way that materially burdens the Site, except ordinary search-engine indexing.

We may restrict access when reasonably necessary to protect the Site, its users, or our rights.

6. Intellectual property

The Site and its text, artwork, graphics, branding, design, software, and other content are owned by, licensed to, or otherwise lawfully used by SumContext and are protected to the extent applicable under intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to view the Site for personal or internal business evaluation. No other rights are granted. You may not reproduce, distribute, sell, modify, publicly display, or create derivative works from Site content without prior written permission, except as permitted by law.

Client deliverables and associated intellectual-property rights are governed only by the applicable signed client agreement.

7. Third-party services and links

The Site may link to third-party services, including Calendly, LinkedIn, and X. Those services are controlled by their providers and governed by their own terms and privacy practices. SumContext does not control and is not responsible for third-party content, availability, security, or practices. A link does not imply endorsement.

8. Privacy

Our Privacy Notice explains how information associated with the Site is collected, used, and disclosed. Review it before using the Site or a linked scheduling service.

9. Disclaimers

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” SumContext disclaims express and implied warranties relating to the Site, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and noninfringement.

We do not promise the Site will always be available, secure, error-free, or current. Nothing in these Terms excludes a warranty or right that applicable law does not permit us to exclude.

10. Limitation of liability

To the fullest extent permitted by law, SumContext will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the Site.

To the fullest extent permitted by law, SumContext’s aggregate liability for claims arising from or related to the Site will not exceed the greater of $100 or the amount you paid specifically for access to the Site during the twelve months before the event giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, bodily injury caused by negligence, or liability that applicable law does not permit to be limited or excluded. Liability arising from paid services is governed by the applicable signed client agreement.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold SumContext harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, or infringement of another person’s rights.

12. Changes to the Site or these Terms

We may modify or discontinue the Site and may update these Terms. Updated Terms apply prospectively when posted with a revised “Last updated” date, unless applicable law requires additional notice or consent. Continued use after an update constitutes acceptance to the extent permitted by law.

13. Colorado law and venue

These Terms are governed by Colorado law, without regard to conflict-of-law principles. A dispute not governed by a separate signed agreement must be brought in a state or federal court in Colorado that has proper jurisdiction and venue. Each party consents to the jurisdiction of those courts.

14. General provisions and contact

If a provision is unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. These Terms and the Privacy Notice constitute the entire understanding concerning use of the public Site, but do not replace or modify a signed client agreement.
